1. Agreement to Terms

 

Welcome to BFO2GO.com (the "Site"), the online retail marketplace owned and operated by BFO ("we," "us," or "our").

These Terms of Service ("Terms") are a binding legal agreement between you (the "User," "you," or "your") and BFO. By accessing, browsing, or making a purchase on this Site, or by creating an account, you agree to be bound by these Terms, our Return & Refund Policy, and our Privacy Policy.

If you do not agree to all of these Terms, do not use this Site.

 

2. Relationship to BFOBIDS.com

 

This Site (https://www.google.com/search?q=BFO2GO.com) is our retail marketplace. We also own and operate a separate online auction marketplace, BFOBIDS.com.

  • These Terms apply only to your use of and purchases from https://www.google.com/search?q=BFO2GO.com.

  • All activity, bidding, and purchases on BFOBIDS.com are governed by its own separate BFOBIDS.com Terms of Use.

 

3. Eligibility and User Accounts

 

You must be at least 18 years of age to make a purchase or create an account on this Site.

To access certain features, including the "Get in the Loop" membership, you must create a customer account. You are responsible for:

  • Providing accurate, current, and complete information.

  • Maintaining the security and confidentiality of your account password.

  • All activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account.

 

4. Retail Sales, Pricing, and Payment

 

  • Product Listings: We strive to ensure all product descriptions, images, and prices are accurate. However, we do not warrant that all information is complete or error-free. We reserve the right to correct any errors and to change or update information at any time without prior notice.

  • Pricing: All prices are listed in U.S. Dollars (USD). Prices do not include sales tax or delivery fees, which will be added at checkout.

  • Payment: We use Shopify Payments (or your designated third-party processor) to securely process all payments. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

  • Sales Tax: We will collect all applicable sales tax based on your shipping or pickup address.

  • Order Refusal: We reserve the right to refuse or cancel any order at our sole discretion, including for reasons such as product unavailability, inaccuracies in pricing, or suspicion of fraud.

 

5. "Loop" and "Swoop" Fulfillment

 

We offer two local fulfillment options for orders placed on this Site.

  • 🛍️ "Swoop it up" (In-Store Pickup): This option is free. Orders must be picked up at our retail location: 200 1/2 Regier Street, Buhler, KS 67522. You will be notified via email when your order is ready.

  • 🚚 "BFO Loop" (Local Delivery): We offer local delivery to the Hutchinson, KS area for a $5.00 flat fee. By selecting this option, you agree to this fee and authorize us to deliver your items to your specified address.

 

6. "Get in the Loop" Monthly Membership

 

This Site offers a recurring monthly subscription service, "Get in the Loop."

  • The Service: For a recurring monthly fee (the "Membership Fee"), subscribers receive "Perks," which include:

    1. Unlimited free "BFO Loop" (Local Delivery) on all eligible orders from this Site (https://www.google.com/search?q=BFO2GO.com).

    2. Free "BFO Loop" (Local Delivery) on all eligible auction wins from BFOBIDS.com, as defined in the BFOBIDS.com Terms of Use.

  • Recurring Billing: By purchasing the "Get in the Loop" membership, you authorize us to charge your payment method the stated Membership Fee on a recurring monthly basis. Your subscription will automatically renew each month unless canceled.

  • Cancellation: You may cancel your "Get in the Loop" membership at any time through your BFO2GO customer account portal. Your cancellation will take effect at the end of your current billing cycle. Membership fees are non-refundable.

  • Termination: We reserve the right to terminate your membership at our discretion, without notice, for any conduct we believe violates these Terms or is harmful to our business interests.

 

7. Intellectual Property

 

All content on this Site, including text, graphics, images, and software, is the property of BFO. Our trademarks, including but not limited to BFO, BFO2GO, BFOBIDS, BFO Loop, Swoop it up, and our logo, may not be used in connection with any product or service without our express prior written consent.

 

8. Prohibited Conduct

 

You agree not to use this Site for any unlawful purpose, including but not limited to:

  • Interfering with the Site's security or operation.

  • Using any "bot" or "scraper" to access or copy data.

  • Submitting false or misleading information.

  • Committing fraud or any other illegal activity.

 

9. Disclaimer of Warranties; Limitation of Liability

 

This Site and all products and services provided are offered on an "as-is" and "as-available" basis, without any warranties of any kind, express or implied.

To the fullest extent permitted by law, BFO shall not be liable for any indirect, incidental, special, or consequential damages (including loss of profits) arising from your use of this Site or your purchase of any product, even if we have been advised of the possibility of such damages.

 

10. Governing Law

 

These Terms, and any dispute arising from them, shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions.

 

11. Changes to Terms

 

We reserve the right to modify these Terms at any time. We will post the revised Terms on this page and update the "Last Updated" date. Your continued use of the Site after such changes constitutes your acceptance of the new Terms.
